We've wasted five years in this country and will waste many more, on Brexit, whose sole purpose was to resolve an internal dispute in the Conservative Party.
Years we could have spent addressing our real, existential crisis, the threat to the living systems that keep us alive. Undue influence is an offence where:
Section 115 of the Representation of the People Act 1983 is amended as follows.
In subsection 2, after paragraph (b) there is inserted—
if, by systematic organisation or by contrivance, he directly or
indirectly engages in, or is party to, or benefits from, the
practice of inducing or misleading an elector or proxy for an
elector, or electors generally, to vote for a political party or a
candidate for election to any office when his object is to
accumulate votes for a candidate whose objectives include—
(i)
undermining the electoral system, or taking such steps
as would have that effect, or
(ii)
deliberately misleading the electorate as to the reasons
for voting for that candidate.”.
The Representation of the People's Act 1983.
No Court has ever considered whether false statements were made during the referendum to influence the result. Nevertheless, had a Court decided that an official campaigning body was guilty of contravening s 115, the broader political implications may well have been significant. What impact, if any, of an adverse finding against the official campaign bodies in such proceedings on subsequent events is therefore anyone’s guess. https://ukconstitutionallaw.org/2017/03/22/richard-clayton-qc-the-brexit-case-that-never-was/?fbclid=IwAR2Rv-u7itDfs9TRF-udzj6pitPlTQrjoUv5YP2giLDhHg2iwdmiM08pvmw
the Brexit process, the public remain surprisingly unaware that the decision to leave the EU was made by the Prime Minister and not in the 2016 referendum (which was advisory) or by Parliament (which bestowed discretion on the Prime Minister in the 2017 withdrawal Act 2017).
In fact, responsibility and accountability for this monumental decision have only been successfully established by the tenacity of individual litigants, who have not let the issue be kicked under the carpet by those in power. In the cases of Miller, Webster and Wilson, the three women Claimants have boldly taken the lead in highlighting the dangers for our democracy in the Brexit process.
